After the Leader presented his report, it was proposed by the Leader and seconded by Councillor Bob Bayford and Members agreed by recorded vote the recommendations detailed in the report, namely to:

 

1.  Adopt the Thanet Local Plan, subject to the modifications set out in the Inspectors’ Report;

and

2.  Adopt the Landscape Character Assessment as a Supplementary Planning Document.

 

A recorded vote took place on this item due to the nature of the meeting being completely virtual.

 

The Monitoring Officer conducted a recorded vote on the motion as follows:

1 Member voted against the motion: Councillor Kup.

 

8 Members abstained from voting on the motion: Councillors Bambridge, Boyd, Dexter, Fellows, Paul Moore, Potts, Scott and Wright.

 

2 Members were unable to vote due to technical difficulties: Councillors Crittenden and Dennis.

Cabinet noted that consideration of the draft Local plan proposals were now at the final stages of the work towards the adoption of a new Local Plan for Thanet. The Plan was part of the Council’s policy framework and was therefore required to be adopted by a meeting of the full Council, which was now scheduled for 9 July 2020.

 

The draft Thanet Local Plan was submitted for independent Examination in October 2018. Examination hearings commenced on 2 April 2019 and finished on 18 July 2019. Following the Examination, the Planning Inspectors recommended a number of Modifications to the draft Plan. These proposed Modifications were subject to a public consultation.

 

The Inspectors had since considered the representations made during the consultation and had submitted their report to the Council, which was attached to the Cabinet report as Annex 1. The Inspectors were required to make a judgement about the “soundness” of the draft Plan. The overall conclusion of the Inspectors’ Report was that the draft Plan was “sound”, subject to the adoption of the Modifications recommended within their report. The Modifications were attached at Annex 2 of the Cabinet report.

 

Members considered the final draft of the Local Plan, incorporating the Inspectors’ recommended Modifications, which was attached to the Cabinet report as Annex 3. This report recommended the modified Local Plan be recommended to full Council for adoption. The report also recommended that the Landscape Character Assessment be adopted as a Supplementary Planning Document.

 

Councillor Bob Bayford, Chairman of the Overview & Scrutiny Panel presented a summary of the key comments that came from the Panel meeting on 26 May and confirmed the recommendation in support of the adoption of the new draft Local Plan. These comments were detailed in the published Panel minutes.

 

Councillor Game spoke under Council Procedure Rule 20.1.

 

Councillor Everitt proposed, Councillor Yates seconded and Cabinet recommended the following to Council:

 

1.  Adoption of the Thanet Local Plan, subject to the modifications set out in the Inspectors’ Report;

and

2.  Adoption of the Landscape Character Assessment as a Supplementary Planning Document.

Councillor Bayford, Chairman of the Panel made the opening remarks under this item and commented as follows:

 

·  The report by the Independent Inspector concluded that the draft Local Plan was sound only if all the modifications proposed by the inspectors were accepted;

·  This is because these modifications are considered by the Inspector’s to be necessary to make the plan sound and legally compliant, capable of adoption;

·  The decision to be made by the Council was either to adopt the plan with the Inspector’s modifications or to not adopt the Plan;

·  It was not up to the Council to either partially accept modification or to make further changes to the Plan that go beyond the inspector’s report, as this would leave the Council with a Plan that was not sound;

·  The role of the Panel was to consider the draft Plan and the Inspector’s main modifications and make recommendations for Cabinet to consider prior to forwarding its final recommendations to Council;

·  The recommendation in the report should be changed to read as follows:

 

v  The Overview and Scrutiny Panel is recommended to consider the main modifications from the Inspector’s report and what representations if any to make to Cabinet, for Cabinet to consider before making its final recommendations to Council.

 

Adrian Verrall, Strategic Planning Manager led the discussion and said that the key modifications from the Inspector’s report were highlighted in the committee report and the related annex. Mr Verrall also made the following comments:

 

·  It was important to have an adopted Local Plan in place, as this ensured that the Council would have a strong Planning Policy Framework that gave greater control over the planning process;

·  The plan also provided certainty for local communities about the scale and location of local development;

·  The Plan also provided support to the work of the team that processed planning applications particularly when it came to dealing with planning applications for large housing sites and appeals;

·  The document could also be used for funding bids and ensure that infrastructure was provided in a timely manner;

·  Without a sound Local plan there was a risk of intervention by the Secretary of State. This would also place the council at risk in terms of appeal decisions and losing control of the development process.

 

Members made a number of comments for consideration by Cabinet as follows:

 

·  Could the Climate Emergency Working Group and the Local Plan Review Cabinet Advisory Group work collaboratively in order that any key issues that emerge from the work of the Working Group that included climate change would be forwarded to the Cabinet Advisory Group and captured in the final recommendations going to Cabinet, as these issues could added to the Local Plan as part of the Local Plan review;

·  Green infrastructure projects – could the publicly accessible woodlands projects that were not implemented in the previous plan that included Dane Velley Woods be included in the new plan?

Cabinet acknowledged that the Council was now at the final stages of the work towards the adoption of a new Local Plan for Thanet. Members were also advised that there would also be an opportunity for the final draft plan to be discussed at the Overview and Scrutiny Panel on 26 May 2020. The final draft of the Local Plan, incorporating the inspectors recommended modifications was attached to the Cabinet report as annex 3. Cabinet agreed that this report together with the Inspectors’ modifications be recommended to full council for adoption.

 

The report also recommended that the Landscape Character Assessment be adopted as a Supplementary Planning Document.
