    PROPOSAL: Application for the approval of reserved matters to outline planning permission OL/TH/14/0404 (erection of 12no. dwellings) for erection of a 3 storey 4 bed detached dwelling

     

    It was proposed by Councillor Tomlinson, seconded by Councillor Campbell and RESOLVED:

     

    “THAT the officer’s recommendation be adopted, namely:

     

    ‘That the application be APPROVED subject to the following conditions:

     

     1  The development hereby approved shall be carried out in accordance with the submitted drawings numbered PR262.02 Rev A, PR262.03 Rev B, PR262.04 Rev B, PR262.05 Rev B and PR262.06 Rev B, received on the 1st August 2018.

     

    GROUND;

    To secure the proper development of the area.

     

     2  Prior to the first occupation of the development hereby approved visibility splays of  2.4 by 25m hall be provided to the access on to North Foreland Avenue with no obstructions over 0.6m above carriageway level within the splays, which shall thereafter be maintained.

     

    GROUND;

    In the interest of highway safety.

     

     3  The area shown on the approved plans for vehicle parking and manoeuvring areas, shall be kept available for such use at all times and such land and access thereto shall be provided prior to the first occupation of the dwelling hereby permitted.

    Development without adequate provision for the parking or turning of vehicles is likely to lead to parking inconvenient to other road users and detrimental to amenity and in pursuance of policy D1 of the Thanet Local Plan.

    PROPOSAL: Erection of 8No. 3 storey 2 bedroom dwellings

     

    It was proposed by Councillor Tomlinson, seconded by Councillor Campbell and RESOLVED:

     

    “THAT the officer’s recommendation be adopted, namely:

     

    ‘That the application be APPROVED subject to the following conditions:

     

    1  The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

     

    GROUND;

    In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Purchase Act 2004).

     

     2  The development hereby approved shall be carried out in accordance with the submitted drawings numbered 18.1279.MB.PL104 received 27th July 2018, 18.1279.MB.PL103 Rev A received 9th July 2018 and, 18.1279.MB.PL102 Rev B received 31st July 2018.

     

    GROUND;

    To secure the proper development of the area.

     

     3  Prior to the construction of the external surfaces of the development hereby approved samples of the materials to be used shall be submitted to, and approved in writing by, the Local Planning Authority. Development shall be carried out in accordance with the approved samples.

     

    GROUND;

    To safeguard the special character and appearance of the area as a Conservation Area  in accordance with advice contained within the National Planning Policy Framework.

     

     4  No development shall take place until details of the means of foul and surface water disposal, including details of the implementation, management and maintenance of any proposed Sustainable urban Drainage Systems, have been submitted to and agreed in writing by the Local Planning Authority. The development shall be carried out in accordance with such details as are agreed and thereafter maintained.

     

    GROUND:

    To prevent pollution, in accordance with the advice contained within the National Planning Policy Framework. Notes:

     

     5  No further alterations to the buildings or erection of garden buildings or erection of boundary or internal fences or means of enclosure, whether permitted by the Town & Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that order with or without modification) or not, shall be carried out without the prior permission in writing of the Local Planning Authority.

     

    GROUND:

    To ensure a satisfactory external treatment and in the interests of the visual and residential amenities of the locality in accordance with Policy D1 of the Thanet Local Plan.

     

     6  No external metre cupboards, vents, flues or etract grilles or overhead supply cables shall be installed without the prior agreement in writing with the Local Planning Authority.

    To safeguard the spaceial character and appearance of the area as a conservation area in accordance with the National Planning Policy Framework.

     

     7  Prior to the first occupation of the development hereby approved of the development, the secure cycle parking facilities, as shown on approved drawing no. 18.1279.MB.PL102 Rev B shall be provided and thereafter maintained.

    In the interests of promoting increased cycling in accordance with policy TR12 of the Thanet Local Plan’”

    PROPOSAL: Change of use of land to 4 glamping pitches

     

    It was proposed by Councillor Tomlinson, seconded by Councillor Campbell and RESOLVED:

     

    “THAT the officer’s recommendation be adopted, namely:

     

    ‘That the application be APPROVED subject to the following conditions:

     

    1  The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

     

    GROUND;

    In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Purchase Act 2004).

     

     2  The development hereby approved shall be carried out in accordance with the submitted drawings numbered Location Plan and Typical Layout.

     

    GROUND;

    To secure the proper development of the area.

     

     3  No more than 4 tepees shall be occupied at any one time on the site.

     

    GROUND;

    In order for the Local Planning Authority to assess any potential impact from an amount that would exceed that indicated on the approved drawing; in the interests of highway safety in accordance with the provisions of the NPPF.

     

     4  The use of the tepees hereby approved shall be restricted to the dated between 1st May and 31st October inclusive.

     

    GROUND;

    In order for the Local Planning Authority to assess any potential impact for the use of the site over a longer period than that stated in the application; in the interests of neighbour amenity in accordance with the provisions of the NPPF.’”

    Minutes:

    PROPOSAL: Erection of a close boarded fence to a maximum height of 1.83m to front elevation together with erection of decking to rear elevation

     

    Speaking as ward councillor was Councillor Brimm.

     

    It was proposed by the Chairman and seconded by Councillor Tomlinson:

     

    “THAT the officer’s recommendation be adopted, namely:

     

    ‘That the application be REFUSED for the following reason:

     

    1  The fence, by virtue of its prominent location, height and materials, forms a dominant and visually intrusive element within the street scene, severely detrimental to the open character and appearance of the area, contrary to Policy D1 of the Thanet Local Plan, and paragraphs 127 and 130 of the National Planning Policy Framework.’”

     

    Further to debate, the motion was put to the vote and declared LOST.

     

    Then, it was proposed by Councillor Campbell and seconded by Councillor Ashbee:

     

    That the application be APPROVED subject to safeguarding conditions for the following reason:

     

    “Members felt that the proposed development would not harm the character and appearance of the area.”

     

    Upon being put to the vote, the motion was declared CARRIED.
