Iain Livingstone, Planning Applications Manager outlined the report.

Annabel Hemmings, Principal Planning Officer provided further detail of the report.

 

It was proposed by the Chair and seconded by the Vice-Chair:

 

THAT the officer’s recommendation to defer and delegate to officers for approval the application subject to the following safeguarding conditions and the submission of a signed legal agreement within the following 12 month period securing the heads of terms outlined, with the adoption of the shadow HRA at Annex 3 to the Planning Committee report:

 

No development shall commence within any phase until details of the appearance, landscaping, layout and scale (hereinafter called the ‘Reserved Matters’) for that Phase have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the details as approved.

 

GROUND:

 

As no such details have been submitted in respect of these matters as part of the application is in outline. In accordance with Section 92 of the Town and Country Planning Act 1990.

 

2.  The application for the first Reserved Matters shall be made no later than the expiration of 3 years beginning with the date of this planning permission. Applications for the approval of the remainder of the Reserved Matters shall be made to the Local Planning Authority before the expiration of 8 years from the date of this planning permission.

 

GROUND:

 

In accordance with Section 92 of the Town and Country Planning Act 1990.

 

3.  Each phase of the development shall be begun within two years of the date of approval of the final reserved matters to be approved for that phase.

In accordance with Section 92 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

 

4.  The development shall provide for not more than 1,461 dwellings, of which no less than 1% shall be made available for self or custom build housing plots, and the gross floor space provision across the development for other purposes shall not exceed that stated below:

 

 - Primary School – 2.05ha site / up to 2 form entry

- Local Centre – 2200sqm gross internal floor area (comprising use classes E, F1 and F2)

 

GROUND:

 

For the avoidance of doubt, so as to ensure that any development is in accordance with and within the parameters of that assessed by the Local Planning Authority for the purposes of the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 and in the interest of achieving sustainable development, in accordance with Thanet Local Plan Policy QD02, and the principles with the National Planning Policy Framework.

 

5.  Any reserved matters applications submitted pursuant to the outline part of this approval shall accord with the following approved access and parameter plans:
