LICENCE TO DRIVE PRIVATE HIRE VEHICLES

Further to debate, the Licensing Board agreed:

 

This was an application for a licence to drive a Hackney Carriage.

 

The issue before the Licensing board for determination was whether or not the applicant is a fit and proper person to hold a licence to drive a Hackney carriage, following his conviction for assault occasioning actual bodily harm in November 2019.

 

We heard from the Council's Licensing officer, from the applicant himself and we have had sight of a Pre-Sentence Report prepared by the Probation Service.

 

We note that the applicant has held a licence to drive either a Private Hire Vehicle or a Hackney Carriage since 2008 and that this conviction is the first matter relating to an offence of violence to come before this Licensing Board in those 12 years.

 

We are satisfied, unanimously, that the applicant remains a fit and proper person to hold a licence to drive a Hackney Carriage.  Accordingly his licence is now reinstated.

 

However, the Licensing Board will be giving the applicant a formal written warning in respect of his conduct.  It is important that applicant appreciates that may have his licence permanently revoked should he commit any further offences.

LICENCE TO DRIVE PRIVATE HIRE VEHICLES

Further to debate, the Licensing Board agreed:

 

This was an application for a licence to drive a Private Hire Vehicle.

 

The issue before the Licensing Board was whether or not the applicant is a fit and proper person to hold a licence to drive a Private Hire Vehicle. 

 

We have heard evidence about an offence involving social security fraud which was committed by the applicant in 2011.  We noted that this conviction is now more than 8 years old. 

 

We were impressed by the applicant's determination to become employed and by the four character references which were supplied on her behalf. 

 

In all the circumstances; we are satisfied that the applicant is a fit and proper person to hold a licence to drive a Private Hire Vehicle.  Accordingly, we grant this licence for a full year.
