The Head of Safer Neighbourhoods introduced the report.
Kent Police addressed the Sub-Committee.
The Licence Holder’s representative addressed the Sub-Committee.

Further to debate, Members agreed:
The Sub Committee has considered the agenda papers including the application and supporting documentation & representations made by the Police and the DPS Mr Sinnathurai and his representative.
The Sub Committee considered the application in the light of the Licensing Act 2003, the Council’s Licensing policy, Article 6 of the Human Rights Act 1998 (the right to a fair trial) and the licensing objectives, namely the prevention of crime & disorder & the protection of children.
The Sub Committee considered whether revocation was proportionate. It was noted that there were no written complaints from the public. It was reprehensible to sell alcohol to a child in January 2019 but the Sub Committee noted there is a refusal register which is comprehensive. It is a serious matter to revoke a premises licence, it is property. There were concerns about the evidence produced of minor variation of the licence as there appears to be a discrepancy as to what was agreed about the sale of high strength alcohol.
On the evidence given on this occasion, the Sub Committee did not think it is fair and proportionate to revoke the licence.
