Further to debate, Members agreed:
Having heard from the Applicant, the Objector and Ms Penny Button, Head of Safer Neighbourhoods at Thanet District Council
Having taken legal advice from Ms Tara O’Leary of counsel, acting as Legal Advisor to the Sub-Committee
Having considered its powers and duties under the Licensing Act 2003, the Statutory Guidance and Thanet District Council’s Statement of Licensing Policy
The Applicant having also agreed to amend the operating hours for the premises, from those specified in his licensing application to those which are permitted under planning consent for the premises.
The Sub-Committee is satisfied that it is in accordance with the licensing objectives to grant the application, but the licence is to be subject to the two following additional conditions:
1. Any recorded music and live music must not be audible in neighbouring premises.
2. This Applicant must comply with a schedule for cleaning the pavement and frontage of the premises. The schedule is to be agreed with the Licensing Team at Thanet District Council within 28 days of the grant of licence and will remain in force thereafter. It may be amended at any time with the agreement of the Licensing Team. |
