There were no members of the public or responsible authorities making representations.

 

Councillor Wright joined the meeting at the start of this item. The Interim Senior Litigation Lawyer checked with the Applicant who had no issue with the late arrival.

 

Alison Brock, Licensing Officer, presented the report.

 

The Applicants addressed the Sub-Committee.

 

Members asked questions of the Applicant.

 

Further to debate, Members agreed:

 

 

“This was an application to vary Premises Licence Number LN/201300142, relating to premises known as The West Bay Café, Sea Road, Westgate-on-Sea, Kent.

 

The Applicant, Mr Alan Dolan, assisted by Ms Kate Witherden, has applied to vary this premises licence to include off-sales for alcohol every day between 10am and 10:30pm.

 

In the lead up to this Sub-Committee hearing, the Applicant agreed with Thanet District Council’s Environmental Health Team to set the terminal hour for off-sales of alcohol to 10pm, and this is the application presently before us for consideration.

 

We have received one objection to this application from an interested party living in the vicinity of the premises, who expresses concerns about noise nuisance, littering and anti-social behaviour.

 

We note though, for the purposes of the statutory guidance regarding crime and disorder that the Kent Police Service have not expressed any concerns regarding this application. No Responsible Authority has made any representation regarding this application.

 

We have paid very close attention to all of the material and evidence which has been put before us.

 

In all the circumstances and having considered all of the evidence before us, we are satisfied that this application can be granted, to allow off-sales of alcohol at the premises between 10am and 10pm every day of the week. We have also noted that the applicant currently conducts a twice daily litter pick in the vicinity of the premises, and has offered to accept a condition on the licence to underpin this responsible approach. Accordingly, we consider it to be appropriate, proportionate and necessary for the promotion of the licensing objectives, to impose a condition on the licence in the following terms: -

 

-  The licence holder shall conduct a twice daily litter pick in the vicinity of the premises to remove any litter which has or may have resulted from sales made at the premises.”
