Further to debate, Members agreed:
“This was an application for a new premises licence brought by Mr Mark Hicks in respect of 15 The Parade, Margate, Kent CT9 1EY.
The Applicant seeks a licence to allow the following licensable activities at the following times: Late Night Refreshment – Monday to Sunday 23:00 to 01:30 the following day, and 23:00 to 02:00 the Following day on New Years Eve. Supply of Alcohol for consumption both on and off the premises – Monday to Sunday 10:00 to 01:00 the following day and 10:00 to 02:00 the following day on New Years Eve.
The business proposed is that of a bar & restaurant, the Applicant currently holds an existing Premises Licence in respect of the premises located immediately next door at 16 The Parade.
We have heard evidence from the Applicant, the Licensing and Environmental Health Services and from a local resident objecting to this application. This in addition to a second written objection.
Having paid very careful attention to all of the evidence that has been placed before us we are satisfied that this application, amended as it is, not to include any part of the Piazza, can be granted.
Conditions agreed between the Applicant and the Environmental Health Service are: 1. The licensed area shall only include the internal parts of the premises 2. From midnight onward on each operational night, alcohol for off-sale provision shall only be provided in a sealed container.
The amendment of the application to remove the Piazza from the scope of the application, has rendered the third condition agreed between the Applicant and the Environmental Health Service, to be irrelevant.
We consider these two conditions, in all the circumstances, to be appropriate, proportionate and necessary for the promotion of the licensing objectives, and formally apply them to this premises licence.” |
