To consider options for future action following the end of the four month period agreed at the 22^nd January Cabinet meeting for the developers of Royal Sands to have demonstrated the financing for the construction of the development.

It is agreed that Cabinet set a review period of 4 months from 22nd January 2013 and request officers at the end of this period to prepare an options report to Cabinet if either the finance is not in place for the completion of the development or no agreement is in place for the construction and operation of a hotel.

To provide an opportunity to review the progress in achieving the conditions set out by Cabinet in July 2012 and options to move forward if these are not achieved within 4 months.

Cabinet could have agreed the proposal to take action under the development agreement if the developer had not met Cabinet’s conditions by 31^st January. It was considered that this was an arbitrary date that if adopted may have caused problems in relation to achieving the laid down conditions. The agreed recommendation allows the council to review its position with one of the options being the approach set out in the notice of motion.
