Purpose:

·  To agree Increasing the penalty limit for fly tipping offences from £400 to £1000

·  To Increase the early payment option for fly tipping from £300 to £400

·  To agree Increasing the penalty limit for breaches of care notices in relation to waste from £400 to £600

·  To Increase the early payment option for breaches of care notices to £400

Decision:

Local authorities have the option to increase the fines issued under fixed penalty notices for fly tipping and waste and duty of care.

Reasons for the decision:

Adoption of this new limit for fines will deter people from harming our public spaces in the first place, and ensure that those who continue to offend face tougher consequences.

Alternative options considered:

To retain the current levels of fines. Pre-statutory instrument levels of fines do not reflect the severity of the offence or often cover the council costs for removal.
