Royal Sands Development

Cabinet would be asked to agree the following recommendations:

 

1.  To authorise officers to defer the recommendations of the Cabinet paper dated 20th February whilst positive negotiations continue;

 

2.  To authorise the project team (in consultation with the S151 Monitoring Officer, Head of Paid Service and Cabinet Member for Finance and Estates) following due process and procedures to progress with negotiations;

 

3.  That a report be brought back to Cabinet in October 2014, documenting the outcome of the negotiations for final decision.

This decision will be taken under urgency procedures.

Reason for urgency:
The following are the reasons for requesting that the key decision regarding Royal Sands Development be considered by Cabinet under General Exception Regulations:

•On 20 February Cabinet had instructed a breach notice to be served on the developer in connection with the development agreement;
•Service of the notice then triggered a request for mediation, this is within the development agreement contractual terms;
•As part of the mediation process new circumstances were made available to the council;
•These circumstances have resulted in officers seeking instructions from Cabinet in the form of the cabinet paper;
•These developments have taken place very recently, the Council needs direction from Cabinet fairly quickly on how to proceed in this matter, and therefore cannot wait for the proposed report to be included in a future publication of the Forward Plan & Exempt Cabinet Report List.
